CONSTRUCTION LAW: You can't represent real estate developers without an intimate knowledge of the construction lien law. Notices to owner, notices of commencement, claims of lien, and the time deadlines associated with the lien statute, all of which must be strictly complied with, can pose traps for the unwary. We have represented general contractors, subcontractors and owners since 1980. In fact, we were the disbursing agent for the construction loan for the Sawgrass Mills Mall, which required us to disburse over $6 million a month from our trust account in exchange for appropriately completed lien releases, contractor affidavits and supporting documentation. We worked closely with Chase Manhattan Bank, on what was then the largest construction loan in the history of Broward County and upon the conclusion of construction, the owner had no lien disputes whatsoever.
